Who is responsible

What data we process

Account data — the email address and credentials you register with, plus your language and display preferences.

Prescription and profile data — the name, date of birth and optical values (SPH, CYL, AXIS, ADD, PD and similar) you or your optical centre record, together with the issuing centre and date. Optical prescriptions are health data and are treated as a special category under Article 9 GDPR.

Family and sharing data — where you invite a family member or grant another person access to a record, we store that relationship, who granted it and when it expires.

Technical data — information stored in your browser to operate the service (see the cookie policy) and, only if you accept analytics, aggregated usage statistics.

Why we process it (purposes and legal bases)

• To provide the service — performance of a contract with you (Art. 6(1)(b) GDPR).
• To store and display your prescriptions, which are health data — your explicit consent (Art. 9(2)(a) GDPR), given when you create a record. You may withdraw it at any time, which does not affect processing carried out beforehand.
• To keep the service secure and prevent abuse — our legitimate interest (Art. 6(1)(f) GDPR).
• To measure use of the public website — your consent (Art. 6(1)(a) GDPR), requested through the cookie banner and refusable without losing any functionality.
• To comply with legal obligations — Art. 6(1)(c) GDPR.

Who we share it with

We do not sell personal data and we do not use it for advertising. We share it only with providers acting as processors on our instructions:

• Amazon Web Services — hosting and databases, in the eu-central-1 region (Frankfurt, Germany), inside the European Union.
• Google Analytics — aggregated website statistics, and only after you accept analytics cookies. IP addresses are anonymised.

A record you deliberately share with an optical centre or a family member is visible to that recipient until you revoke the access.

Retention

We keep your account and prescription data for as long as your account exists, because the purpose of the service is to preserve a long-term record. You can delete a record, or your whole account, at any time; we then erase the data except where we must retain it to comply with a legal obligation. Analytics data is retained in aggregated form.

Your rights

You may request access, rectification, erasure, restriction and portability, object to processing, and withdraw consent at any time. To exercise these rights, contact info@refracard.com. You also have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, www.aepd.es) or your local supervisory authority.

International transfers

Our hosting is located in the European Union. Where a provider processes data outside the EEA — for example Google Analytics — we rely on an adequacy decision or on appropriate safeguards such as the EU Standard Contractual Clauses.

Changes

We may update this policy; the date above shows the latest version.

Qué datos tratamos

Datos de cuenta — la dirección de correo y las credenciales con las que te registras, junto con tus preferencias de idioma y presentación.

Datos de graduación y perfil — el nombre, la fecha de nacimiento y los valores ópticos (esfera, cilindro, eje, adición, distancia interpupilar y similares) que tú o tu centro óptico registráis, junto con el centro emisor y la fecha. Las graduaciones ópticas son datos de salud y se tratan como categoría especial conforme al artículo 9 del RGPD.

Datos de familia y de acceso compartido — cuando invitas a un familiar o concedes acceso a otra persona, conservamos esa relación, quién la concedió y cuándo caduca.

Datos técnicos — información almacenada en tu navegador para el funcionamiento del servicio (véase la política de cookies) y, solo si aceptas la analítica, estadísticas de uso agregadas.

Por qué los tratamos (fines y bases jurídicas)

• Prestar el servicio — ejecución de un contrato contigo (art. 6.1.b RGPD).
• Almacenar y mostrar tus graduaciones, que son datos de salud — tu consentimiento explícito (art. 9.2.a RGPD), otorgado al crear un registro. Puedes retirarlo en cualquier momento, sin que ello afecte al tratamiento previo.
• Mantener la seguridad del servicio y prevenir abusos — interés legítimo (art. 6.1.f RGPD).
• Medir el uso del sitio web público — tu consentimiento (art. 6.1.a RGPD), solicitado mediante el banner de cookies y rechazable sin perder funcionalidad.
• Cumplir obligaciones legales — art. 6.1.c RGPD.

Con quién los compartimos

No vendemos datos personales ni los utilizamos con fines publicitarios. Solo los comunicamos a proveedores que actúan como encargados del tratamiento siguiendo nuestras instrucciones:

• Amazon Web Services — alojamiento y bases de datos, en la región eu-central-1 (Fráncfort, Alemania), dentro de la Unión Europea.
• Google Analytics — estadísticas agregadas del sitio web, únicamente si aceptas las cookies analíticas. Las direcciones IP se anonimizan.

Un registro que compartes deliberadamente con un centro óptico o un familiar es visible para ese destinatario hasta que revoques el acceso.

Conservación

Conservamos tus datos de cuenta y de graduación mientras exista tu cuenta, porque la finalidad del servicio es preservar un historial a largo plazo. Puedes eliminar un registro, o tu cuenta completa, en cualquier momento; entonces suprimimos los datos salvo que debamos conservarlos para cumplir una obligación legal. Los datos analíticos se conservan de forma agregada.

Tus derechos

Puedes solicitar acceso, rectificación, supresión, limitación y portabilidad, oponerte al tratamiento y retirar el consentimiento en cualquier momento. Para ejercer estos derechos escribe a info@refracard.com. También tienes derecho a presentar una reclamación ante la Agencia Española de Protección de Datos (www.aepd.es) o ante la autoridad de control de tu país.

Transferencias internacionales

Nuestro alojamiento se encuentra en la Unión Europea. Cuando un proveedor trata datos fuera del EEE — por ejemplo Google Analytics — nos basamos en una decisión de adecuación o en garantías adecuadas como las Cláusulas Contractuales Tipo de la UE.

Cambios

Podemos actualizar esta política; la fecha indicada arriba refleja la versión vigente.

Kontodaten — die E-Mail-Adresse und Zugangsdaten, mit denen Sie sich registrieren, sowie Ihre Sprach- und Anzeigeeinstellungen.

Werte- und Profildaten — Name, Geburtsdatum und optische Werte (Sphäre, Zylinder, Achse, Addition, Pupillendistanz und Ähnliches), die Sie oder Ihr Optikfachgeschäft erfassen, samt ausstellender Stelle und Datum. Optische Werte sind Gesundheitsdaten und werden als besondere Kategorie nach Art. 9 DSGVO behandelt.

Familien- und Freigabedaten — wenn Sie ein Familienmitglied einladen oder einer Person Zugriff gewähren, speichern wir diese Beziehung, wer sie erteilt hat und wann sie endet.

Technische Daten — im Browser gespeicherte Informationen zum Betrieb des Dienstes (siehe Cookie-Richtlinie) und, nur bei Ihrer Zustimmung, aggregierte Nutzungsstatistiken.

Warum wir sie verarbeiten (Zwecke und Rechtsgrundlagen)

• Bereitstellung des Dienstes — Erfüllung eines Vertrags (Art. 6 Abs. 1 lit. b DSGVO).
• Speicherung und Anzeige Ihrer Werte als Gesundheitsdaten — Ihre ausdrückliche Einwilligung (Art. 9 Abs. 2 lit. a DSGVO), erteilt beim Anlegen eines Eintrags. Sie können sie jederzeit widerrufen; die vorherige Verarbeitung bleibt davon unberührt.
• Sicherheit des Dienstes und Missbrauchsprävention — berechtigtes Interesse (Art. 6 Abs. 1 lit. f DSGVO).
• Reichweitenmessung der öffentlichen Website — Ihre Einwilligung (Art. 6 Abs. 1 lit. a DSGVO), über das Cookie-Banner eingeholt und ohne Funktionsverlust ablehnbar.
• Erfüllung rechtlicher Pflichten — Art. 6 Abs. 1 lit. c DSGVO.

An wen wir sie weitergeben

Wir verkaufen keine personenbezogenen Daten und nutzen sie nicht für Werbung. Wir geben sie nur an Dienstleister weiter, die als Auftragsverarbeiter nach unseren Weisungen handeln:

• Amazon Web Services — Hosting und Datenbanken in der Region eu-central-1 (Frankfurt am Main, Deutschland), innerhalb der Europäischen Union.
• Google Analytics — aggregierte Website-Statistiken, ausschließlich nach Ihrer Zustimmung. IP-Adressen werden anonymisiert.

Ein Eintrag, den Sie bewusst mit einem Optikfachgeschäft oder einem Familienmitglied teilen, ist für diese Empfänger sichtbar, bis Sie den Zugriff widerrufen.

Speicherdauer

Wir speichern Ihre Konto- und Wertedaten, solange Ihr Konto besteht, da der Zweck des Dienstes die langfristige Dokumentation ist. Sie können einen Eintrag oder Ihr gesamtes Konto jederzeit löschen; wir löschen die Daten dann, sofern wir sie nicht aufgrund einer gesetzlichen Pflicht aufbewahren müssen. Analysedaten werden aggregiert aufbewahrt.

Ihre Rechte

Sie können Auskunft, Berichtigung, Löschung, Einschränkung und Übertragbarkeit verlangen, der Verarbeitung widersprechen und Ihre Einwilligung jederzeit widerrufen. Wenden Sie sich dazu an info@refracard.com. Sie haben zudem das Recht, sich bei der spanischen Datenschutzbehörde (Agencia Española de Protección de Datos, www.aepd.es) oder Ihrer örtlichen Aufsichtsbehörde zu beschweren.

Internationale Übermittlungen

Unser Hosting befindet sich in der Europäischen Union. Sofern ein Dienstleister Daten außerhalb des EWR verarbeitet — etwa Google Analytics — stützen wir uns auf einen Angemessenheitsbeschluss oder geeignete Garantien wie die EU-Standardvertragsklauseln.
